Standard Terms & Conditions

or the purposes of this quotation “MAT” shall mean MAT Electrics Ltd, and “Customer” shall mean the person or the company ordering the services of MAT Electrics Ltd.

1. This quotation shall be open for acceptance for a period of eight weeks from the date of its submission or any other period stated in the tender submission. 
2. If this quotation has not been accepted at the end of the period referred to in clause 1 above, MAT shall be entitled to adjust the price quoted to take account of any increase in the cost to goods or materials necessary for carrying out the work specified. 
3. T
he quotation is based on the assumption that facilities will be provided for the execution of the work during normal working hours unless otherwise stated.  Additional costs due to overtime working at the customer’s instruction will be added to the quoted price.
4. Any additional requirements to the work covered by this quotation will require a signed authorisation from the customer and will be charged for as an extra to this quotation. 
5. Should the project involve any design work from ourselves, we will require a minimum of four weeks to carry out this work, from the date we receive the order.  
6. While every effort will be made to given dates MAT cannot accept liability for failure to do so until a formal programme of work has been agreed. 
7. MAT at their discretion reserve the right to satisfy themselves as to customers’ creditworthiness, where this is deemed necessary this quotation shall not constitute an offer until MAT has so satisfied themselves.
8. MAT at their discretion reserve the right to render interim accounts for materials on or off site, which have been purchased, and for work completed.  Failure to pay any such account within thirty days shall entitle MAT to stop the works until payment has been made.  Any expenses of MAT occasioned by the stoppage and subsequent resumption of the works shall be charged for as extra to this quotation.
9. The property in the works shall remain vested in MAT until payment for such works has been received in full.
10. The customer shall be responsible for any loss or damage howsoever arising to any goods or materials supplied by MAT occurring after such goods or materials have been delivered to site.
11. If any tax or duty imposed on the goods or services supplied as a result of this quotation then in respect of such goods or services the sum payable to MAT shall be increased to allow MAT to recover the amount payable by MAT by virtue of such tax or duty.
12. Where goods have been ordered in compliance with customer’s instructions and the site is subsequently found not to be ready to accept such goods, then adequate and suitable storage must be provided by the customer.  Failing this, the goods will be removed by MAT and any costs incurred by MAT will be charged in addition to this quotation.
13. Every effort will be made to carry out the works with the minimum of disturbance or damage to other trades or property.  However, MAT cannot accept liability for any occurrence under this clause unless due to negligence on the part of MAT employees provided that MAT’s liability for personal injury will be unlimited.
In any event MAT’s liability under this agreement will be limited as follows:
a)   MAT will not be liable for any consequential loss or indirect loss including but not limited to economic loss, loss of profit or loss of use.
b)  Any claim for damage to property will be limited to £5,000,000 for any claim or series of connected claims.
14. This quotation is based and is conditional upon no major obstructions to the installation routes being encountered.  In addition a clear working area must be provided for the unimpeded progress of the works covered by this quotation.  Any failure to provide these facilities may result in extra costs being incurred.
15. We understand and will exercise our statutory right to Interest Rate the Late Payment Commercial Debts (interest) Act 1998.  If we are not paid according to the agreed credit terms.
